Chapter 69 - THE DALLAS LUXURY ORDINANCE

Section 69-1 DEFINITIONS

In this chapter:

(1) DELIVERY OF LUXURY means the process of satisfying the provisions of this chapter through administrative best efforts.  In no event shall any employee or contractor for the City of Dallas be liable for the inability or unwillingness to provide the DELIVERY OF LUXURY.

(2) DRIVING SURFACE means a street, road, parkway or other 

(3) HOMEOWNER means a person who owns a single family home or condominium.

(4) HOTEL PATRON means a person who stays in a city-owned or city-operated facility or domicile and pays rent on a daily or hourly (excluding city-owned or city-operated SEXUALLY ORIENTED BUSINESS facilities; as defined in Chapter 41A of this Code) basis.

(5) POTHOLE means a defect in the surface of a street or road which is maintained by the City of Dallas or contractors working for the City of Dallas.  Any POTHOLE having any edge closer than two (2) inches from any edge of an adjacent POTHOLE shall be considered one (1) POTHOLE for purposes of this chapter.

Section 69-2 HOMEOWNER LUXURY

(a) a HOMEOWNER shall be entitled to the DELIVERY OF LUXURY of DRIVING SURFACES containing no more than nineteen (19) POTHOLES per 100 linear feet of DRIVING SURFACE.

(b) in the event the DRIVING SURFACE is less than 100 linear feet, then the number of POTHOLES shall be reduced at the appropriate percentage.  Under no circumstances, however, shall the required minimum aggregate number of POTHOLES be less than nine (9).

Section 69-3 HOTEL PATRON LUXURY

(a) a HOTEL PATRON shall be entitled to the DELIVERY OF LUXURY of the following amenities in each domicile rented:

(1) fresh sheets and pillowcases on a schedule to be determined by an Linen Odor Technician; all city-owned or city-operated facilities covered by this chapter shall employ no fewer than nine (9) Linen Odor Technicians per HOTEL PATRON.

(2) at least two (2) ounces of shampoo to be furnished at HOMEOWNER expense.

(3) one (1) roll of one-ply toilet paper which may be upgraded to two-ply toilet paper by the HOTEL PATRON at the sole expense of the HOTEL PATRON.
